These General Terms govern the use of the digital platform (hereinafter, the "Platform" or the "Marketplace"), accessible via the web domain of the Company and managed by Drilldown S.r.l., with its registered office in Milan, Viale Isonzo 8, C.F./P.IVA 12392590969 (hereinafter, the "Company").
Through the Platform, the Company allows users (hereinafter, the "Users") to consult and purchase food products marketed by third parties (hereinafter, the "Sellers").
The Company operates as a digital marketplace, providing the technology necessary for the publication of catalogs, their internationalization through scalable technology, enhancing the user experience through proprietary nutritional filters, up to managing the cart, the payment process, and operational support. The Company is not a contracting party in the sale of the products offered by the Sellers.
The Platform exclusively hosts products offered by third-party Sellers, who act independently in managing their catalogs, logistics, and commercial relations with the User.
The sales contract is understood to be concluded directly between the User and the chosen Seller.
The Company acts as a facilitator of the transaction, without owning the goods or assuming responsibility for their availability, quality, compliance, or suitability for use.
The Platform allows the User to create one or more carts, each related to a single Seller, and to complete the purchase directly on the website through secure payment systems.
Payment is collected by the Platform as an entity appointed by the Seller, with automatic crediting to the Seller, net of agreed commissions.
The conclusion of the order is confirmed via email to the User and the Seller. The latter is responsible for managing the order, shipping, and post-sale assistance.
The invoice and/or payment confirmation related to the purchase is issued directly by the Seller, based on the tax data provided by the User at the time of the order.
The Company is not responsible for any errors or omissions in the entered data, nor can it intervene in the fiscal management of the transaction.
The Seller is solely responsible for fulfilling the order, choosing the carrier, the shipping timing, and communicating the tracking code where applicable.
Any delays, delivery errors, damages, or shortages must be reported to the Seller, who is required to provide feedback according to their own general conditions.
The Company may provide a generic assistance service to facilitate communication between the User and the Seller, without assuming direct responsibility.
The right of withdrawal is recognized to the User within the limits provided by Legislative Decree 206/2005 (Consumer Code) and must be exercised directly towards the Seller.
The methods and terms for withdrawal are specified in the Seller’s contractual documentation or can be requested through the contact form available on the Platform.
The Company assumes no responsibility concerning:
a) the veracity, completeness, or timeliness of the information provided by the Sellers; b) the actual availability of the offered products; c) the fulfillment of the order, delivery, and return management; d) post-sale assistance and any disputes between User and Seller.
The Company guarantees the proper technical functioning of the Platform, the reliability of the payment systems used, and the adoption of high-security standards.
The Company reserves the right to modify these General Terms at any time. Changes will take effect from the date of their publication on the Platform and will be deemed accepted by Users continuing to use it.
These General Terms are governed by Italian law.
For any dispute that may arise between the Parties regarding the interpretation, validity, or execution of this document, the exclusive jurisdiction will be that of the Court of Milan, without prejudice to the protection afforded to the User under current consumer legislation.
